Data protection information for web users

1. What information does this document contain for you?

TK Elevator (Canada) Limited ("TK Elevator," "we," "us," and "our") respects your privacy and is committed to protecting it through our compliance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial private-sector privacy legislation, including (where applicable) Quebec’s Act Respecting the Protection of Personal Information in the Private Sector (as amended by Law 25).

We have adopted this Privacy Notice to explain our privacy practices with respect to information that we may collect about you when you access our website www.tkelevator.com/ca-en and its respective mobile version (together, the "Site"). Please read this Privacy Notice carefully to understand our practices regarding the information we collect from you or about you and how we will treat it.

By accessing or using the Site, you acknowledge that you have read and understood this Privacy Notice. This Privacy Notice may change from time to time. Your continued use of the Site after we make changes is deemed to be acceptance of those changes. If you do not agree with our policies and practices, you have the choice not to use our Site.

3. Scope and amendments to this privacy notice.

This Privacy Notice applies to TK Elevator (Canada) Limited and where applicable its affiliates that operate under shared privacy and data handling practices. It outlines how we handle personal information collected through your interaction with us in the following ways:

• On or through this Site.
• In email, text, and other electronic messages between you and us or the Site.
• Through mobile and desktop applications you download, which provide dedicated non-browser-based interaction between you and our Site.

It does not apply to information collected by: 

• TK Elevator offline or through any other means or any third party (including affiliates or subsidiaries).
• Any third party (including our affiliates, divisions, or subsidiaries), including through any application or content that may link to or be accessible from or on the Site.

• 3.1. Our Site is not intended for children. We do not knowingly collect personal information from minors under the age required for valid consent under applicable law, including under 14 years of age in Quebec, without parental or legal guardian consent. If we learn that we have collected personal information from a minor without proper consent, we will delete it. If you believe we might have any personal information from or about a minor, please contact us at dpo@tkelevator.com.
• 3.2. We reserve the right to update this Privacy Notice periodically. Any changes will be communicated via our Site and other appropriate channels used by our subsidiaries and divisions.

4. Which data categories do we use and where do they come from?

Personal information, or personal data, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

• 4.1. We may collect, use, store and transfer different kinds of personal information about you which we have grouped together as follows:
  
  • Identity or Contact Data includes name, email address, telephone number, or similar identifier.
  • Technical Data includes internet protocol (IP) address, browser type and version, time zone setting, location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Site.
  • Transaction Data includes details about products and services that you have purchased from us, where applicable.
  • Profile Data includes your interests, preferences, feedback and survey responses.
  • Usage Data or Navigation Data include information about how you use the Site.
  • Marketing and Communications Data includes your preferences in receiving marketing from us and your communication preferences.
• 4.2. We may also collect, use and share Aggregated Data such as statistical or demographic data for any purpose, which we do not treat as personal information. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a feature on the Site. However, if we combine or connect Aggregated Data with your personal information so that it can directly or indirectly identify you, we treat the combined data as personal information which will be used in accordance with this Privacy Notice.
• 4.3. We collect this information through:
  
  • Direct interactions. You may give us information about you by filling in forms or by communicating with us via e-mail or otherwise. This includes information you provide when you provide your name, mailing address, email address, phone number, business address, business email, etc.
  • Automated technologies or interactions. As you interact with our Site, we may automatically collect technical data about your equipment, browsing actions and patterns as specified above. We may collect this information by using cookies, server logs, web beacons, and other similar technologies (see Cookies and Automatic Data Collection Technologies).
  • From our service providers. This includes businesses that collect your personal information on our behalf in order to help us respond to consumer inquiries, conduct market research, and comply with legally mandated disclosure requirements.
  • Other third parties or publicly available sources. We may receive information about you if you visit other websites employing our cookies or from third parties including, for example, business partners, payment processors, sub-contractors, social network platforms, analytics providers, search information providers, data brokers, or aggregators including, where applicable, Canadian service providers or publicly available sources.

5. What are the purposes for processing your data?

• 5.1. We use the information that we collect about you or that you provide to us, including any personal information:
  
  • To present the Site to you.
  • To fulfill any other purpose for which you provide such information.
  • To respond to your inquiries, concerns, and receive your feedback regarding our Site, including through physical mailings and responses to online surveys, if applicable.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, if applicable.
  • To notify you about changes to our Site, or any products or services we offer or provide through it.
  • To allow you to participate in interactive features on our Site.
  • In any other way, we may describe when you provide the information.
  • For any other purpose with your consent.

• 5.2. Where required by applicable law (including in Quebec), we will obtain your express consent for purposes that are not necessary to provide the Site or your requested services, such as non-essential analytics, personalization, and marketing communications.

• 5.3. We may also use the information you provide to us to contact you about our own and third-party goods and services that may be of interest to you. For more information, please see Sections 6 ("Who receives your data?") and 9 ("Which data protection rights can you claim?").

• 5.4. We may also use your contact information, including your mobile phone number, to send you service-related or informational text messages. We will only send messages with your consent. We do not share mobile numbers or text messages consent information with third parties for marketing purposes. • 5.5. Our Site uses automatic data collection technologies to distinguish you from other Site users. This helps us deliver a better and more personalized service when you browse our Site. Depending on how you access our Site, whether through one of the sites comprising the Site or through your mobile device, we collect information to improve our Site by enabling us to:
  
  
  • Estimate our audience size and usage patterns.
  • Store your preferences so we may customize our Site according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to the Site.

• 5.6. Where permitted by law and subject to your consent where required (including in Quebec), we may use these technologies to collect information about your online activities over time and across third-party websites or other online services for analytics and website improvement purposes. Details on how to manage or withdraw consent are described below.

• 5.7. We may use Google Analytics or similar tools to help us understand how users interact with our Site. Where required by law (including in Quebec), Google Analytics and similar non-essential analytics technologies will be used only with your express consent. These tools may collect information such as device identifiers, IP address, browser type, pages visited, and time spent on the Site. We use this information in aggregate to measure Site performance and to compile statistical reports.

• 5.8. The technologies we use for this automatic data collection may include:

• 5.9. We use cookies and similar technologies, including analytics cookies, where permitted by law. Non‑essential cookies are used only with your consent, which you may provide or withdraw through our cookie management tools. 6. Who receives your data?

• 6.1. We may disclose aggregated information about you and information that does not identify any individual, without restriction.
• 6.2. We may disclose personal information that we collect, or that is provided by you as described in this Privacy Notice:
  
  • We will disclose personal information to the third-party service providers that we engage to assist us in making the Site available. These service providers consist of our datacenter provider(s), storage provider(s), customer support system provider(s), email service provider(s), and software development contractors. These third parties have access to your personal information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
  • To contractors, service providers, and other third parties we use to support our business, and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Site are among the assets transferred.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
• 6.3. We may also disclose your personal information:
  
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our terms and conditions and other agreements.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of TK Elevator, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
• 6.4. Your personal information may be processed or stored outside of Canada, including in the United States or other jurisdictions where we or our service providers operate. When personal information is transferred outside of Canada or Quebec, we take steps to assess the risks and to protect such information through appropriate contractual and organizational safeguards designed to provide a level of protection comparable to that required under applicable Canadian and Quebec privacy laws.

7. How is your data protected?

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. We urge you to be careful about giving out information in public areas of the Site. The information you share in public areas may be viewed by any other users of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

8. How long do we retain your data?

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Notice, comply with legal obligations, resolve disputes, enforce agreements, protect our legal rights, and satisfy legitimate business requirements. When personal information is no longer needed, it will be securely deleted, anonymized, or otherwise disposed of in accordance with our records management practices.

9. Which data protection rights can you claim?

Depending on your jurisdiction, you may have the right to:

• Request access to your personal information;
• Request correction of inaccurate personal information;
• Withdraw consent, subject to legal or contractual limitation;
• Request deletion or de-indexing, where applicable; and
• Request data portability, where required by law (including Quebec).

Additional rights may apply to Quebec residents under applicable provincial law. We will respond to access and correction requests within the timeframes required by applicable law (generally within 30 days, subject to permitted extensions). If you withdraw consent, we may not be able to provide certain features or services. Additional rights and processes may apply depending on your province, including Quebec.

10. Regulatory Complaints

If you are not satisfied with our response, you may have the right to file a complaint with the Office of the Privacy Commissioner of Canada. If you are located in Quebec, you may also file a complaint with the Commission d’accès à l’information du Québec (CAI). Depending on your province, you may have the right to contact the applicable provincial privacy authority.
